What We Acquire
Junior Lien Claim Acquisitions
SurplusFactor evaluates and purchases qualifying junior lien claims associated with foreclosure surplus, including eligible subordinate mortgage and other creditor interests.
What qualifies as a junior lien claim?
Junior lien claims are subordinate interests in real property that may, depending on jurisdiction and foreclosure structure, give rise to a claim against surplus proceeds from a foreclosure sale. Not every subordinate lien creates a valid surplus claim.
Junior and second mortgages
Subordinate mortgage interests recorded after the senior lien. Balance, priority and foreclosure effect must each be verified.
Private mortgages
Mortgages held by private lenders, family offices or non-institutional creditors. Documentation and perfection require individual review.
HOA and condominium liens
Association assessment liens where the jurisdiction and governing documents support a surplus claim post-foreclosure.
Construction and mechanics liens
Where applicable law preserves a mechanics lien claim against surplus after foreclosure. Timing, notice and perfection are critical.
Assessment liens
Municipal or special assessment liens that may survive foreclosure and create a claim against surplus in certain jurisdictions.
Other subordinate liens
Other recorded subordinate interests that may, upon verification, qualify as a creditor claim to surplus proceeds.
What we evaluate
Lien validity and perfection
We verify that the lien was properly recorded, perfected and remains unsatisfied. Recording alone does not guarantee validity or priority.
Priority against competing claims
Junior lien claims are subordinate to senior interests. We analyze the priority stack, identify competing claims and measure available surplus against the full priority chain.
Foreclosure effect
The effect of foreclosure on a junior lien varies by jurisdiction and foreclosure type. We determine whether the specific foreclosure preserved, modified or extinguished the surplus claim.
Surplus coverage
We measure verified available surplus against higher-priority unresolved claims and the subject claim. Strong coverage supports, but never substitutes for, full priority and validity analysis.
Assignability
Assignment of a mortgage, a lien and a specific surplus claim are distinct legal questions. We verify what can be transferred and under what procedure.
Documentation
Mortgage, note, recorded lien, assignment history, payoff statement, foreclosure complaint, certificate of sale, certificate of disbursements and title report are typically reviewed.
Not every junior lien qualifies. Qualification requires individual verification of validity, priority, perfection, available surplus and assignability. Face value alone does not determine what a claim is worth. Submission of a claim does not constitute an offer to purchase.
