SurplusFactor
Responsible Transactions
The principles that govern every SurplusFactor transaction.
No obligation to sell
Submitting a claim is an evaluation request. It creates no obligation on either party, and you may withdraw at any point before executing transaction documents.
Clear purchase price
Any offer we make states a defined cash purchase price. We do not present vague valuations or contingent figures as offers.
Clear identification of what is being transferred
Transaction documents identify precisely what rights, claims or interests are being assigned or purchased. Assignment of a judgment, a lien, a specific surplus claim and proceeds are distinct, and the documents say which applies.
Opportunity to review transaction documents
You receive the transaction documents before closing and have the opportunity to review them. Nothing is executed under time pressure.
No concealment of known material transaction terms
Material terms of the transaction, including price, structure and what SurplusFactor receives, are stated in the documents.
No implication of government affiliation
SurplusFactor is a private company and is not affiliated with any court, government agency or public official.
No guaranteed valuation before underwriting
We do not quote or imply a purchase price before verification and underwriting. Submission of a claim does not constitute an offer to purchase.
Face value is not claim value
We do not assume that a recorded judgment or lien creates a valid claim to surplus proceeds, and we do not present face value as the measure of what a claim is worth.
Independent legal review encouraged
Where appropriate, we encourage creditors to have transaction documents reviewed by their own counsel before execution.
